Terms of Use / EULA — PackMobi

Last updated: 26 October 2026 · Version 1.1

This is a translation of the Thai original (EULA.md). Where the two differ, the Thai version prevails, except where mandatory consumer or data-protection law in your country provides otherwise.

These terms form an agreement between the Developer (the maker and operator of the PackMobi application — "the Developer" or "we") and the merchant or person using PackMobi ("you"). By using the app you accept these terms and the Privacy Notice, which forms part of them.

PackMobi is for business use by people aged 18 or over.

1. Licence

The Developer grants you a non-exclusive, non-transferable licence to use PackMobi, revocable on the terms set out here. You may not modify, reverse engineer or resell the app, except to the extent mandatory law allows (for example the interoperability rights granted under European Union law).

2. What the service is, and what it is not

PackMobi is a tool for recording and storing evidence, to help you manage videos of goods being packed. It is not an insurance service, and the Developer is not an arbiter of disputes between you and your customers, e-commerce platforms or carriers.

3. Data protection roles and Data Processing Agreement

3.1 Roles. For the videos, audio and images of staff or customers, you are the controller of personal data, because you decide to record and you use the result.

3.2 Your obligations as controller. You represent and agree that:

3.3 Data Processing Agreement (effective when the cloud service is enabled). Made under GDPR Article 28(3) and PDPA section 40.

Item Terms
Subject matter and nature of processing Storing, backing up and delivering evidence clips and related data, solely to provide the service under these terms
Types of data and categories of data subjects Images and audio of staff, end customers and people near the packing point; data burned into the clip; related evidence data
Duration For as long as you use the service, ending as set out under "Return and deletion" below
Controller's instructions The Developer processes only on your documented instructions, and will tell you if it considers an instruction unlawful
Confidentiality Anyone with access to the data is bound by a duty of confidentiality
Security Appropriate technical and organisational measures under GDPR Article 32, as described in the Privacy Notice section 8
Sub-processors You authorise the sub-processors listed in the Privacy Notice section 5. The Developer will give advance notice before adding or changing them, and you may object on reasonable grounds. The Developer remains liable for its sub-processors.
Assistance with data subject rights The Developer will give you reasonable assistance with data subject requests, impact assessments and consultations with supervisory authorities
Breach notification The Developer will notify you without undue delay on becoming aware of a breach affecting your data, with the information you need to notify your supervisory authority
Audit The Developer will provide the information needed to demonstrate compliance with this clause and will allow reasonable audits by prior arrangement
Return and deletion On termination, the Developer will delete or return your data as you choose, unless it must be kept by law or is subject to an unresolved dispute
International transfers Rely on the Standard Contractual Clauses described in the Privacy Notice section 6

4. Ownership of clips

The clips are 100% yours. The Developer claims no rights in them, does not use them for advertising, and never uses your videos to train artificial-intelligence models.

5. Evidence share links (bearer links)

Any evidence share link works as a bearer link: anyone holding the link can view the video until it expires or is revoked. As controller, you are responsible for sending links carefully to the right people, and disclosure resulting from sending a link to the wrong person is your responsibility.

6. Prohibited use

You agree not to:

7. Fees, renewal and refunds

Payment, if any, is handled by Google Play, and subscriptions renew automatically under the store's terms. Deleting the app or your account does not cancel a subscription — you must cancel it in Google Play yourself. Prices, refunds and any statutory cancellation right follow Google Play's policies and the consumer law that applies to you.

8. Suspension and termination

The Developer may suspend or terminate your access if you breach these terms, break the law, or fail to pay. Except in serious cases or where the law requires otherwise, we will warn you and give you an opportunity to put it right first. You may stop using the service at any time by uninstalling the app or closing your account. Legal obligations and the retention of data in case of a dispute survive closure of an account.

9. No guarantee of dispute outcomes

The Developer does not guarantee that evidence recorded through the app will be accepted by a carrier, an e-commerce platform or a court. The outcome of a dispute depends on the terms and judgement of the body deciding it.

10. Limitation of liability

The Developer provides the app "as is" to the extent the law allows. The Developer's total liability to you for all claims combined will not exceed the fees you paid to the Developer in the 12 months before the event.

Nothing in this clause limits or excludes liability that cannot lawfully be limited, including wilful misconduct or gross negligence, death or personal injury, and liability under data protection law arising from the Developer's own acts.

11. Data loss

In the local-first version, all clips are stored only on your device and there is no cloud backup. If you uninstall the app, clear its data, or lose or damage the device, all evidence clips are permanently lost and the Developer cannot recover them. We recommend exporting or backing up important clips yourself.

12. Users in the EU, EEA and UK

If you are in the European Union, the EEA or the United Kingdom:

13. Governing law

These terms are governed by and construed under the law of Thailand, without affecting clause 12. If these terms are translated and a conflict arises with the Thai version, the Thai version prevails, unless the consumer law applying to you in your country provides otherwise.

14. Changes to these terms

We will give reasonable advance notice of material changes through the app or the contact details you have given us. If you do not accept a change, you may stop using the service and cancel your subscription.
